CHARTER TERMS & CONDITIONS

Charter rates are generally based on the standard MYBA (Mediterranean Yacht Brokers Association) Terms. These rates include the hire of the yacht, the crew, crew meals, and the yacht’s insurance.

All additional operational expenses are the responsibility of the charterer and are covered via an Advanced Provisioning Allowance (APA). These expenses may include (but are not limited to):

  • Guest food and beverages

  • Fuel for the main engines, generators, tenders, and water toys

  • Dockage, port and harbor fees

  • Communications

  • Any other incidental costs unless specifically stated otherwise in the charter agreement.


APA (Advanced Provisioning Allowance)

The APA is typically estimated at 35% of the charter fee, though this percentage can vary depending on guest preferences, yacht type, and itinerary.

  • APA funds are due at least 30 days prior to embarkation, allowing the crew ample time to provision the yacht to your specifications.

  • The Captain will maintain a detailed account of all expenditures, with receipts available upon request at any point during the charter.

  • If actual expenses exceed the APA amount, the charterer is responsible for covering the difference before disembarkation.

  • Any unused APA funds will be refunded at the end of the charter, along with a final expense report, typically in the local currency.


Taxes & Local Expenses

Local VAT or sales taxes may apply depending on the yacht’s flag and cruising location. These rates vary by region and will be disclosed in your booking documentation.

Specialty provisioning or services coordinated through a local maritime agent (such as VIP dock bookings, ground transportation, or rare food/beverage sourcing) may incur additional fees. These costs will be itemized within the APA accounting.


Yacht Sale Disclaimer

Please note that many charter yachts are also actively listed for sale. In the rare case that your selected yacht is sold prior to your trip, Worth Avenue Yachts will source a replacement of equal or higher quality to fulfill your booking. Trip Cancellation Insurance is strongly recommended for added peace of mind—we’re happy to provide a quote upon request.


Children & Family Considerations

Some yachts require a nanny or additional crew member for children under 14. If you’re traveling with children, let us know in advance so we can suggest yachts that are more suitable for families.


Gratuity Guidelines

Crew gratuity is entirely at your discretion, but a gratuity of 10%–20% of the charter fee is customary if you are satisfied with the service received. We are happy to provide further guidance based on your experience or assist with gratuity distribution at the conclusion of your charter.


Important Note

Force Majeure

Neither the Owner, the Charterer, Worth Avenue Yachts, nor the crew shall be liable for any failure to perform their obligations under the Charter Agreement due to Force Majeure events.

“Force Majeure” includes, but is not limited to:

  • Acts of God

  • Natural disasters (e.g., hurricanes, earthquakes)

  • Pandemics or epidemics

  • War, terrorism, or civil unrest

  • Strikes or labor disputes

  • Government restrictions, port closures, or travel bans

  • Mechanical breakdowns that could not reasonably have been foreseen or prevented

In the event of Force Majeure, all parties will work in good faith to reschedule the charter or offer a suitable alternative. Refunds or rescheduling are subject to the terms outlined in your individual Charter Agreement and insurance coverage.


AYCA Charter Terms

AYCA (American Yacht Charter Association) Terms are a standard set of conditions commonly used for charters in U.S. waters. Similar in structure to MYBA terms, AYCA agreements clearly outline the responsibilities of both the yacht owner and the charterer. Charter rates under AYCA typically include the use of the yacht and crew, with all other expenses—such as fuel, food, beverages, dockage, and taxes—charged separately and prepaid via an Advance Provisioning Allowance (APA). AYCA offers two variations: Full-Service Terms (all-inclusive with exceptions) and Demise Terms(bareboat-style with more charterer responsibility). Your charter specialist will help determine which structure best fits your itinerary and vessel selection.


IYBA Charter Terms

The IYBA (International Yacht Brokers Association) Charter Terms are widely used for yachts operating in U.S. waters and the Bahamas. These terms are designed to provide transparency and structure, clearly defining the obligations of both the yacht owner and the charterer.

Under IYBA terms, the charter rate typically includes the yacht, crew, and crew wages. All other expenses—such as fuel, provisions, dockage, taxes, and incidentals—are covered by the Advanced Provisioning Allowance (APA), usually estimated at 30%–35% of the charter fee and due prior to embarkation.

IYBA charter agreements are especially common for charters in the Bahamas, Florida, and the broader Caribbean region. Your charter specialist will guide you on whether IYBA or other terms (like MYBA or AYCA) are most appropriate for your selected yacht and cruising area.

All charter bookings are governed by the terms and conditions set forth in the official Charter Agreement, as agreed upon by the yacht owner, the charterer, and any relevant management companies. These terms may follow MYBA, IYBA, AYCA, or other regional standards, depending on the yacht and cruising location.

Worth Avenue Yachts commit to acting in good faith on behalf of our clients and will assist in facilitating communication, documentation, and dispute resolution to the best of our ability.

It is the charterer’s responsibility to review and understand the agreed charter terms, cancellation policies, and any destination-specific regulations—including travel restrictions, taxes, or licensing requirements for watercraft operation. Charterers are strongly encouraged to obtain Travel Insurance and Trip Cancellation Insurance, which may provide protection for covered interruptions or emergencies.
